Emigo Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Emigo ("Emigo," "we," "us," or "our") governing your access to and use of the Emigo mobile application (the "Service"). By creating an account or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 13 years of age to access or use the Service. By using the Service, you represent and warrant that you meet this requirement and that all information you provide during registration is accurate and complete.

Account responsibilities

• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• Each account is personal to you. Accounts may not be shared, transferred, or sold.
• You agree to notify us immediately at emigohq@gmail.com of any unauthorized use of your account.

The Service

The Service allows you to capture and send photographs to friends, view photographs sent directly to you on your device's home screen widget, and maintain "streaks" through regular photo exchange. Certain features — including gallery photo selection, widget friend customization, and additional visual themes — are available exclusively through Emigo Gold, a paid subscription described below.

User content and license

You retain all ownership rights in the photographs you submit through the Service ("User Content"). By submitting User Content, you grant Emigo a limited, non-exclusive license to store, transmit, and display that content to the recipients you designate, solely for the purpose of operating the Service. We do not sell User Content and do not use it for advertising.

You are solely responsible for the User Content you submit, and you represent that you have the right to share it.

Acceptable use

The Service is intended for sharing content with people you know personally. You agree not to use the Service to:

• Create, upload, transmit, or store child sexual abuse material (CSAM), or otherwise sexually exploit a minor in any manner — see the Child Safety section of our Privacy Policy for how such content is handled and reported.
• Transmit content that is sexually explicit, threatening, harassing, hateful, or otherwise abusive toward another person.
• Impersonate any person or entity, or create an account on behalf of anyone other than yourself.
• Transmit unsolicited advertising or promotional material, or make any commercial or automated use of the Service not expressly authorized by us.
• Attempt to gain unauthorized access to another account, interfere with or disrupt the integrity or performance of the Service, or reverse engineer any portion of it.
• Use the Service in violation of any applicable law or regulation.

You may report an account or specific content directly within the Service, and may block any user at any time to prevent further contact.

Enforcement and termination

We reserve the right to remove content, and to suspend or permanently terminate an account, that we determine violates these Terms. Where a violation involves CSAM or the exploitation of a minor, we may take such action immediately and without prior notice. Where a violation is less severe, we will generally endeavor to notify the affected user of the action taken.

You may terminate your own account at any time via Settings → Other → Delete account, as described in our Privacy Policy.

Emigo Gold (subscriptions)

Emigo Gold is an optional, paid subscription that unlocks gallery photo selection, widget friend customization, and additional themes.

• All purchases and billing are processed exclusively through Google Play. Emigo does not receive or store your payment information.
• Subscriptions renew automatically at the price and interval disclosed at the time of purchase, until cancelled.
• You may cancel at any time through your Google Play account settings. Cancellation prevents future renewals but does not entitle you to a refund of the current billing period; Emigo Gold remains active through the end of that period.
• Refunds are governed by Google Play's own refund policy and are not issued directly by Emigo.
• Deleting your Emigo account does not cancel an active subscription. Subscriptions must be cancelled separately through Google Play.
• We reserve the right to modify the features included in Emigo Gold. We will not discontinue a feature you are actively subscribed to and paying for without providing reasonable advance notice.

Intellectual property

The Service, including its name, logo, and associated branding, is the property of Emigo. Except for the limited right to use the Service in accordance with these Terms, nothing herein grants you any right, title, or interest in Emigo's intellectual property.

Third-party services

The Service relies on third-party infrastructure, including cloud storage and hosting providers, Google Firebase (push notifications), Google Play (billing), and an email delivery provider (account-safety notifications). Your use of these integrated services may also be subject to their own terms. See our Privacy Policy for a complete list of third-party service providers.

Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. Photographs in your feed are automatically removed approximately 24 hours after being sent unless saved to Memories; you are solely responsible for preserving any content you wish to retain.

Limitation of liability

To the maximum extent permitted by applicable law, Emigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold Emigo harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

General provisions

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emigo regarding the Service. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.

Changes to these Terms

If we make material changes to these Terms, we will update the date at the top of this page and, where appropriate, notify you within the Service. Your continued use of the Service after a change becomes effective constitutes your acceptance of the revised Terms.
